Facebook competitions
§ 1 General
Participation in the competition of the Facebook fan page: "Tobis Filmclub" (hereinafter referred to as "the organiser") is only possible with the inclusion of these conditions of participation. The competition is not supported by Facebook and has no connection with Facebook.
§ 2 Participation requirements
All natural persons with legal capacity and a minimum age of 18 years may participate. Employees of the organiser and their relatives are excluded from participation. By participating, the participant agrees that his/her name and/or picture may be published on the Internet in the event of a win. Participation is only possible within 7 days after publication of the competition. The legal process is excluded.
§ 3 Profit
The prize will be awarded as advertised in the competition. In the event of several correct entries, the prize will be awarded by drawing lots without recourse to legal action. A change or cash payment of the prize is excluded. The winner will be notified by us via Facebook. If the winner does not respond to the prize notification within one month, the prize will be forfeited without compensation.
§ 4 Liability
Claims for damages against the organiser in connection with the competition are excluded - to the extent permitted by law - irrespective of the legal grounds, unless the organiser has intentionally or grossly negligently breached statutory obligations. Furthermore, the organiser is not liable for damages resulting from the impairment of the availability of the competition website in the event of technical disruptions and force majeure events beyond the organiser's control, as well as attacks by third parties against the competition website. However, the organiser will make every effort to ensure the reliability and functionality of the competition website. Furthermore, the organiser does not guarantee that the competition website will function properly on the respective participant's computer.
§ 5 Data protection
The organiser shall ensure the highest possible standard of data protection in the context of the competition and shall observe all relevant statutory provisions in this respect. The organiser will not pass on any personal data to third parties or sell address data. The organiser will store the personal data of the respective participant solely for the purpose of the competition. The participant hereby expressly declares his/her consent to the storage and use of the personal data provided for the above-mentioned purpose.
§ 6 Severability clause
If individual provisions of these Terms and Conditions of Participation are invalid or if there is a loophole, this shall not affect the validity of the remaining provisions. The invalid or missing provision shall be replaced by a provision that comes as close as possible to the purpose of the contract and the statutory provisions.
§ 7 Place of jurisdiction / applicable law
In the event of disputes, German law shall apply exclusively. As far as legally permissible, the organiser's registered office is agreed as the place of jurisdiction. If the participant does not have a general place of jurisdiction in Germany or moves his/her place of residence abroad after participation, the organiser's registered office is also agreed as the place of jurisdiction.
§ 8 Selection procedure
The winners will be selected by a random generator (http://www.fanpagekarma.com/facebook-promotion). The legal process is of course excluded here as well.
Liability for contents
The contents of our pages were created with great care. However, we cannot guarantee the correctness, completeness and up-to-dateness of the contents. As a service provider, we are responsible for our own content on these pages in accordance with general laws pursuant to Section 7 (1) of the German Telemedia Act (TMG). However, according to Section 8 to 10 TMG, we are not obliged as a service provider to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information in accordance with general laws remain unaffected by this. However, liability in this regard is only possible from the point in time at which a specific infringement of the law becomes known. If we become aware of corresponding infringements, we will remove this content immediately.
